The GMAC Mortgage is even worse! I called them in Oct 2005 about sending them a check to endorse. The check was for 50k, my mortgage was less than 11K. They were going to release the FULL check. They needed a “Notorized” signature on the paper. (At that point no Notary’s were open!) The first guy was very nice and told me they stream lined the process for us. The check was sent without the Notorized letter as I was told by GMAC in California. The check came back in my prepaid overnight envelope not endorsed by GMAC. When I called them about receiving the check back they told me I had to endorse it over to them and they would send out inspectors and give me 3% until proof I’ve done the repairs! I told them to just pay off the mortgage and give me the balance. They told me to send the payment for the mortgage into another office and then they could release my insurance check. I wanted them to deduct the mortage from the insurance check but that could not be done from the California office! WHY it’s my money paying you? She would order the pay off and I should receive it in about 6 weeks and then the money would be send to me. I said forget it and sent them the endorsed check to them overnight again. GMAC sent me the check back for my endorsement again in my prepaid FEDX, my husband and I signed on the same line of the check so they thought it wasn’t signed by both! Very clearly 2 signatures on the checks. I sent the check again and here we sit…1/2/06 (since October 12th) and still no check. Supposely I should get the check within 7 to 10 days from 7 days ago!
What else can we do but get an attorney? Worse part of it all is I have another mortage with them that hasn’t been settled yet! UUGH!
I had my attorney get the pay off for the mortgage and it only took a day! Go figure an attorney can get a response in 24 hours when the mortgage SUPERVISOR will take 6 weeks… maybe check the supervisors knowledge here!
